Software License, Support & Refund Agreement

By Purchasing Any Product From the Store Webiators, You Agree to the Following:

• This license agreement (hereinafter “Agreement”) is an agreement between you (the person or company who is being licensed to use the Software or Documentation) and Webiators Technologies PVT. LTD. (hereinafter Webiators/We/us/our). The Agreement applies to all products/software/scripts/services you purchase from us. 

• By purchasing the Software you acknowledge that you have read this Agreement and that you agree to the content of the Agreement and its terms, and agree to use the Software in compliance with this Agreement. 

• The Agreement comes into legal force at the moment when you order our Software from our site or receive it through email or on a data medium at our discretion. 

• We are the copyright holder of the Software. The Software or a portion of it is a copyrightable matter and is liable to protection by the law. Any activity that infringes the terms of this Agreement violates copyright law and will be prosecuted according to the current law. We reserve the right to revoke the license of any user who is holding an invalid license. 

• This Agreement gives you the right to use only one copy of the Software on one Magento installation solely for your own personal or business (eCommerce) use, subject to all other terms of this Agreement. A separate License should be purchased for each Magento installation. Any distribution of the Software without our consent, including noncommercial distribution, is regarded as a violation of this Agreement and entails liability, according to the current law. 

• Any use of the Software other than for your personal or business Magento instance is subject to a custom priced license. This includes but is not limited to internal projects, research, analytics, marketing. Any possible distributions or use in your other projects for your commercial benefit is subject to written permission given by Webiators. 

• You may not use any part of the code in whole or part in any other software or product or website. 

• You may not give, sell, distribute, sub-license, rent, lease or lend any portion of the Software or Documentation to anyone. You may not place the Software on a server so that it is accessible via a public network such as the Internet for distribution purposes. Eg: Github 

• You may not remove or alter any brand, copyright, disclaimer, terms of use, attribution, or any other proprietary notices or marks within the extension code including but not limited to Webiators branding in file names, class names, variables, texts, or UI items. 

• You are bound to preserve the copyright information intact, this includes the text/link at the bottom. 

• We will not be liable to you for any damages (including any loss of profits/saving, or incidental or consequential) caused to you, your information, and your business arising out of the use or inability to use this Software. 

• We are not liable for prosecution arising from the use of the Software against law or for any illegal use. 

• If you fail to use the Software in accordance with the terms and conditions of this License Agreement, it constitutes a breach of the agreement, and your license to use the Software is revoked. 

• Webiators Technologies PVT. LTD. reserves the right to change this license agreement at any time and impose its clauses at any given time. 

• The license agreement remains effective until terminated. We retain the right to terminate your license to use the Software at any time, if in its sole discretion, you are not abiding by the terms of the Agreement, including, but not limited to, obscuring or removing any link or copyright notice as specified in this agreement. You may terminate it at any time by destroying all copies of the Software. Termination of this Agreement does not bind us to return you the amount spent for purchase of the Software, if more than fourteen days have passed since the purchase date. Webiators Technologies PVT. LTD. reserves the right to terminate all software licenses, all orders and support services for a customer convicted in violation of the Agreement. 

• The Customer agrees and accepts that they will not use the Software for any purposes other than their personal and/or business use and in strict accordance with the present Agreement and Webiators Terms and Conditions. 

• If you continue to use the Software after Webiators Technologies PVT. LTD. gives you notice of termination of your license, you hereby agree to accept an injunction to enjoin you from its further use and to pay all costs (including but not limited to reasonable attorney fees) to enforce our revocation of your license and any damages suffered by us because of your misuse of the Software. 

Distribution

• Sharing of extension package or service is strictly prohibited without official permission including non-commercial or personal distribution will lead to the violation of this Agreement and causes liability, according to the Indian law. 

Upgrades

• We do offer a timely upgrade and updates to improve our extensions which are completely FREE UPGRADES FOR LIFETIME. You can download the latest package from your account section
• Webiators reserves the right to determine which products will be updated and when or to discontinue product updates.

Customization

• The extension is open source that means you are free to customize the extension according to your business need only for the licensed domain.
• Also, you may not use or resell any part of the extension or code in any manner.
• If you are looking for customizing the extension, you can use our Magento Custom Extension Development Service for that purpose. We will help you to customize the extension the way you love it.

Support Agreement

We do offer FREE 90 Days Support for all paid extensions until you are 100% satisfied. But...

• All the support tickets and requests are queued based once you have submitted them. Duplicating such tickets or making multiple requests will not help you to get quicker support and it automatically discarded.
• The Customer shall provide all the necessary and required information to save time until we don't get access we are unable to assist you.
• If your support period is over, the team has the right to refuse support requests. You can buy support separately by contacting us.

Governing Law

If you continue to use our extension or service even after termination, you are liable to pay all costs (including lawyer fees) and any damages suffered by us because you have misused our extension or services. This Agreement is construed in accordance with the laws of the State of Madhya Pradesh, India and both the parties will hear by consent to the jurisdiction of the courts of the State of Madhya Pradesh, India.

By accepting all these mentioned conditions, it denotes that you are using our products, services, or support at your own risk. And Webiators reserves the right to change this Extension & Service License Agreement at any time.

Refund Policy

Webiators offers a 60 days refund policy. To ensure our customer protection, customers can request a refund within 60 days from the date of the purchase.

We offer refunds if we are unable to solve the problem in Webiators extension/module/plugins as advertised in the user guide and product demo. It is mandatory that the customer must provide us with server access including [ GIT OR FTP access ].

Refunds do not include any extended feature, conflict with other plugins and software. Although Webiators extensions/modules/plugins/ are compatible with every theme or template.

In case of theme or template incompatibility customers need to provide the server access [ GIT or FTP details ] and we will ensure that our modules/plugins/extensions are fully compatible with Webiators extensions.

To request a refund please share the details at our customer support system. Our dedicated team will ensure that you will get the refund within 5 business days.

Customers must ensure that they have deleted all the copies/files of Webiators software from their server/host.

Also, they need to confirm the same via email to our helpdesk system.

Refunds will not be granted in case of installation and customization or consultancy services.

We are highly focused on our customer's happiness. We also offer a refund as a credit feature as well.

If our software is not working properly as advertised and we are unable to fix the problem, in that case, the customer may also request a refund as a credit. Which they may use in another Webiators product/service purchase.
